​1. Copyright & Intellectual Property

All artworks, images, photographs, and related visual materials displayed on this website are the exclusive property of Joyce van den Engel, unless stated otherwise. These works are protected under international copyright laws and may not be copied, reproduced, distributed, or used in any form without prior written permission.
 
You are welcome to view this website for personal, non-commercial purposes only. Downloading, printing, or saving images from this site is permitted solely for private viewing or reference, and does not grant ownership or licensing rights.
 
You may not:
- reproduce, distribute, or publicly display any artwork or image from this website;
- use the artwork or photographs for any commercial, promotional, or editorial purpose; 
- modify, edit, or create derivative works based on the images; or
- use any image in a way that infringes on the artist's moral or economic rights

1b. Ownership of Copyright After Purchase

When you purchase an original artwork or print from Joyce van den Engel, you are acquiring the physical object only. All copyright and reproduction rights remain the exclusive property of the artist.

This means you may not: 
- reproduce the artwork in any form (including digital reproduction, NFTs, or merchandise);
- use the artwork image for commercial or promotional purposes; or
- claim authorship or ownership of the intellectual property.

If you wish to license or reproduce any of Joyce van den Engel's artworks for editorial, promotional, or other uses, you must obtain prior written permission.

1c. Protection and Representation
​
All artworks are visibly and invisibly protected and registered to ensure the artist's copyright  is respected. Unauthorized use or reproduction of any image will be monitored and may be subject to legal action.

Joyce van den Engel is professionally represented through Pictoright, which manages and protects image rights for visual artists in the Netherlands and abroad.
She is also a member of the BOK (Beroeps Organisatie Kunstenaars), a national association supporting the interests and rights of professional artists.

2. Acceptable Use

You agree to use this website only for lawful and legitimate purposes, and in a manner that does not infringe the rights of, restrict, or inhibit anyone else's use and enjoyment of the site.

You must not:
- use this website in any way that is unlawful, fraudulent, harmful, or connected with any illegal activity;
- attempt to gain unauthorized access to any part of the website, server, or data; 
- use this website in a manner that could damage, disable, overburden, or impair it's functionality or accessibility
- attempt to copy, extract, or scrape content, images, or data from this site by automated or manual means; 
- use this website to transmit unsolicited communications or promotional materials (spam)​

I reserve the right to restrict or terminate acces to any part of this website  at my sole discretion, if I believe that it violates these terms or applicable law. ​​

3. Accuracy of Color Display 
​​
Each artwork shown on this website has been photographed and presented with great care to ensure an accurate and faithful representation of it's colors and details.

Please note that the colors may appear slightly different depending on the settings, brightnes, and color calibration of your device. Such variations are normal and depend on the viewer's own display environment.

4​​. Authenticity and Edition Information

Each print is part of a limited edition. Because every artwork is available in two sizes, every size is treated as its own small edition. The exact edition size will be defined once sales begin, with a maximum of 20 prints per size.

Every print is hand-signed on the front, and the edition number and date are written on the back. All markings are handwritten by the artist. Once the edition size for a specific print and format has been set and all copies are sold, no further prints of that artwork and size will be produced. 

Minor variations in signature placement, numbering, or surface texture are a natural result of the hand-finishing process and contribute to the individual character of every print. These details form part of the artwork's authenticity and ensure the uniqueness of each piece.


5. Protective Coating

Every print  is hand-finished with a professional artist-grade matte spray (Lascaux or Hahnemühle) for UV and surface protection. This process ensures long-lasting durability without altering the appearance of the print.

If you prefer to receive your print without protective coating, please contact me before placing your order.

Minor variations in texture or tone are a natural result of the hand-finishing process and are considered part of the print's unique character. 
 

6. Purchases

By placing an order through this website, you agree to purchase the selected artwork or print at the listed price. All prices are shown in euros and include taxes where applicable.

Please ensure that all product details, such as size, materials, and finish, are correct before completing your purchase. Once an order is confirmed, no further changes can be made.

In the unlikely event of a pricing description error, the artist reserves the right to correct the information or cancel the order before shipment.
 

7. Return Policy

All purchases made through this website are final once production has begun. Each print is made to order, and for that reason, cancellations or returns are not accepted after your order has entered production.
​
Before placing an order, please review all product details carefully. 
​​
If your order arrives damaged, please contact me within 7 days of delivery at jvdengel@hotmail.com, including clear photographs of both the damaged print and it's packaging. I take great care in the production and packaging process, but if damage occurs during shipping, a replacement will be arranged at no additional cost.

Prices for artworks and prints may be updated or adjusted in time. Changes in pricing do not affect orders that have already been completed.

All prices are listed in euros. Product prices include VAT where applicable and do not increase at checkout. Shipping costs are calculated at checkout based on destination.  


9. Payment Terms

All payments are processed securely through the payment providers integrated with this website. Your order will be confirmed and processed only after full payment has been received. 
​
I reserve the right to cancel or decline any order if a payment is not succesfully authorized or if fraudulent activity is suspected. ​

By placing an order, you confirm that the billing and payment information you provide is accurate and complete, and that you are authorised to use the payment method submitted.

10. Shipping & Customs /Import Taxes

Fine art prints and original artworks may be subject to custom duties, import taxes, or handling fees when shipped outside the European Union. These charges are determined by your local customs authority and are not included in the purchase or shipping price shown at checkout.

I have no control over these additional costs and cannot predict their amount. Customs policies vary widely from country to country; if you are unsure whether such fees apply, please contact your local customs office before placing an order.

For customers within the European Union, no customs fees or import taxes apply.
​​
If a shipment is returned to me due to unpaid customs fees, import taxes, or a refusal by the customer to accept delivery, the customer remains responsible for all related costs. Refunds or replacements will not be issued for items returned for these reasons.

I reserve the right to refuse or cancel orders to destinations where international shipping restrictions apply or where reliable delivery cannot be guaranteed.

Shipping times may vary, and any delays caused by postal services or customs processing are outside my control and are not grounds for cancellation or refund.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the Netherlands.
Any disputes or claims arising out of or in connection with these Terms, are subject to the exclusive jurisdiction of the Dutch courts.

I reserve the right to update or modify these Terms of Service at any time without prior notice. Any changes will be posted on this page, and the revised version will take effect immediatly upon publication.
It is your responsibility to review this page periodically to stay informed of any updates.
